The Constitution Protects Batman's Vigilante Activities
For years Batman and the Bat-Family have been active in Gotham City. Batman had the whole GCPD trying to haul him in when he first started out, but the GCPD's stance on vigilantes changed greatly under James Gordon's direction. Gordon has insisted that Gordon will employ full force GCPD to bring Batman down should he violate his no-kill rule. Batman is essentially totally approved to work in Gotham City as much as he likes, though, until he breaks that restriction.
Gordon most certainly is simply applying a liberal reading of the Constitution to simplify Batman's life. Gordon also provides some very crucial information at this press conference regarding how vigilantism is not only tolerated in Gotham City but also looks to be fully encouraged by both the police force and the United States Constitution.
Gordon acknowledges in his news conference that vigilantes are let in Gotham City as long as they are ready to cooperate fully with the police. This posture not only lets the vigilantes assist in apprehending criminals but also gives Batman total anonymity, therefore enabling Batman to assist in capturing as many criminals as he wishes without Gordon ever having to admit that Batman did.
