Kevin Hart Wins Big: sex tape Lawsuit Headed to Private Arbitration!
This one's a wild ride, folks! Kevin Hart's friend, Jonathan "JT" Jackson, sued Hart for $12 million, claiming Hart falsely implicated him in a sex tape extortion scheme; and failed to meet conditions of an agreement which stated Hart should exonerate him publicly. Jackson wanted this messy saga in open court; a public trial where everything would’ve become completely exposed to everyone. However, a Los Angeles County judge ruled otherwise, sending everything to private arbitration; a huge blow to Jackson’s own legal strategy!
Judge Daniel S. Murphy's decision came down Thursday after Jackson's Wednesday court appearance where his attorney Daniel Reback argued that a special, emphasized clause within that initial settlement, actually made a public exoneration by Hart a key part for it becoming effective! If Hart didn't make a specific statement online, including wording meticulously planned by Jackson's own lawyers – then Jackson's own obligations in that settlement should’ve become null; including the entire clause concerning that private arbitration! Reback even accused Hart of fraud! He allegedly sent a fake email to implicate Jackson to divert suspicion from Hart’s own sex tape scandal back in 2017!
Hart's lawyer, Donte Mills, didn’t mince words. He called out Jackson's intentions as attempting to "embarrass" Hart. Mills said that the private arbitration clause clearly defined how everything must be resolved. The argument itself involved many smaller elements concerning the agreement, highlighting the critical need for the initial agreement between both parties to make arbitration a valid procedure, even creating debate over the validity and specific terms written; as well as attempting to define which specific court processes must be applied. The argument is far more detailed than originally expected.
Judge Murphy agreed. His ruling clearly states that those arguments made concerning other issues were not necessarily important regarding how arbitration was originally decided and confirmed by Jackson himself. "The case is stayed in its entirety pending the outcome of arbitration," he stated. This decision doesn’t dismiss that initial case, creating an immediate legal effect on whether the trial continues or gets completely dismissed.
Jackson – an actor and pro bowler– had a minor part in Hart’s 2014 film Think Like a Man Too. He confirms he joined Hart on that infamous 2017 Vegas trip; and denies extortion. This was despite him getting arrested in 2018; a criminal charge subsequently dropped; with him claiming Hart orchestrated the events by creating that fake email demanding bitcoins, later harming Jackson's career using a Netflix docuseries where that earlier extortion claim got restated– even after charges dropped!
Their initial negotiation involves Hart publicly stating he was mistaken – which would also require including an apology stating that charges were dropped, all clearly defined in this earlier negotiated statement that the lawyer Reback emphasized at the hearing; that earlier emphasized contract highlighted and referenced this explicitly, further emphasizing that this crucial element was deemed highly critical for the continuation of this very specific agreement. Jackson claimed Hart completely ignored these aspects!
Hart's Instagram post does refer to that lost friendship – but not to Jackson’s innocence. It sounds neutral, and thus doesn't meet those specifications provided and argued upon.
Jackson's rep says they are appealing! Hart's lawyer confirms their determination: "We will hold people to their agreements," states Donte Mills in an email sent to Rolling Stone. It looks as if Jackson's lawyers were quite frustrated with the decision given all the points previously made by them. However, Hart appears to be in a winning position. That private arbitration would surely make the trial happen without media, resulting in that intense private process focusing entirely upon resolving those remaining matters.
This isn't over. That initial suit, the massive financial requests, all the drama is unresolved – moving now into a very private arena, meaning those fans hoping to have seen an intense public hearing remain completely disappointed, yet this situation promises more future development. We wait to see what emerges from this private showdown.
